“Although Art did not get too concerned with technical legal details of each
issue, he had an amazing ability to see the big picture and push us to come up
with creative arguments that many times led to important wins such as Encore
Videos v. San Antonio in zoning and Sundance Associates v. Reno with regard to 2257
regulations, among many others. Certainly in Colorado he helped establish that
our state constitution provides broader protection to free speech than the First
Amendment to the United States Constitution.
“Art’s trial artistry was not limited just to First Amendment cases; and he had
some singular trial successes in all types of criminal cases all over the country. He
could connect with a jury whether he was in Fort Worth, Miami, Council Bluffs or
Louisville.”
Apparently, one of Art’s classic performances was in an obscenity case defending
the legendary Al Goldstein. According to Mike Gross, “Art wore a green leisure
suit in Wichita in the ’70s during the Al Goldstein [Screw Magazine] trial with
Herald Fahringer and Paul Cambria.”
Industry attorney Paul Cambria reported, “We were trying the Goldstein case in
Wichita and Art was trying to convince the jury that it was a New York City-only
publication and the postal inspectors brought it into Kansas, so he pointed to an
enema ad and said the number is New York City so you’d obviously need a hell of
a long hose for it to affect Wichita.”
In the late 1990s, after decades of defending obscenity prosecutions, Arthur
admitted to one interviewer that doing so required “a certain amount of creativity
on the battlefield.” Having done so myself, I certainly agree. And nobody did it any
better than Arthur.
One of my clients, whom Arthur had represented for many years until he
retired, suggested that I write this article. I agreed to do it before the sentence
suggesting it was finished. It was too long coming. And a little over 1,000 words
doesn’t do the topic justice. Someone should write a book.
Jessica Drake Invites Industry to
Join Team Wicked for AIDS Walk
Wicked Pictures contract star and sex educator Jessica Drake invites those in the
adult industry to join Team Wicked on October 23 for AIDS Walk Los Angeles.
Drake will lead Team Wicked for the fifth time.
“Once again, I am so excited about Team Wicked and AIDS Walk Los Angeles
and all the support we’ve been getting,” Drake said. “Every year, Team Wicked
is one of the top fundraising teams, and we really want to keep that going. This
year, we’ll also be utilizing our platform and high visibility to increase voter
awareness in an effort to defeat Prop 60. Our team T-shirts, banners and signs
will say #NoProp60, and I’m asking everyone in the industry to support us and
join in our effort to raise money for a cause that is very dear to our hearts and at
the same time, help us educate voters.”
Team Wicked raised $15,416 last year, for a total of nearly $70,000 over the
past four years for the event benefiting AIDS charities. This year, Team Wicked
aims to raise $20,000 and so far has raised $5,500 or 28 percent of that goal,
making it second among all Teams participating. Drake herself has raised
$2,800 to the effort for fifth place among individual donors. Those interested in

owner Steve Orenstein. “While it is still early, it seems this year both the size of
the team and money raised will be higher than ever.”
