an attorney. If you register your copyright
with the Copyright Office of the Library of
Congress, either before the infringement
commences or, in any event, within three
months (as opposed to 90 days) from first
publication, you can recover attorney’s fees
and giant statutory damages. The details
of that, too, are beyond the scope of this
piece.
Performers’ Rights
Everyone has a right to the commercial
value of his or her image, voice and
likeness. That legal concept was born
in the late nineteenth century. The
commercial value of most folks’ grille,
however, is not really worth very much;
so many states—especially California and
New York—have enacted statutes that peg
a value on it. And the teaser is attorney’s
fees. So, for example, if your image is used
for commercial purposes in California, you
can recover at least $750, plus attorney’s
fees.
A “release,” in industry parlance, is
when a performer sells the rights to his
or her image. The contents of a release
are important: Rights of alteration, rights
of distortion, waiver of right to credits,
arbitration of disputes and more all are
important components of a good release.
So, the performer signs the gold
standard of releases. A year later, he or
she has seller’s remorse. A lawyer sends a
letter claiming that the client/performer
was drunk, drugged, held at gunpoint or
whatever and otherwise would never have
performed in a “porno.” Directors need to
deal with that possibility.
As long as you are collecting 2257
information, do a little preventive medicine
as well. A pneumonia shot is cheaper than
pneumonia. This is particularly important
with new female and gay performers.
This is the suggestion: Write a script
that includes the following: 1) Shoot the
2257 identification and have the performer
acknowledge the validity of it; 2) talk
about what will take place in the scene;
and 3) for performers who are of marginal
age, create a script that will detect fake or
fraudulently obtained (more likely) ID,
with loaded questions that will confirm the
performer’s age. Interview each performer
with that script and keep the footage—just
in case! When your knockout potential star
decides to cry foul, you will be protected.

Some may not know what a hotbed
of adult content production the
“City of Brotherly Love” is—and
that industry is a growing one, as
evidenced by the arrival Philarise
Productions, whose content, found

content from.

Videos on the site, some of which feature such well-
known performers as Tasha Reign, Miley May, Morgan Lee
and newcomer Onyx Muse, tend to run about half-an-hour,
but there are also plenty of sexy photos to peruse with each
video rental—and now, with the HotMovies deal, there are
even more viewing options.
“Our newest update was yesterday; we posted a video
featuring Jade, who’s a first-timer, and if you go to our site,
you can stream the full video in 1080p from us for $2.95
and you also get the photo set, or you can go to HotMovies.
com and choose to watch the full video right there, or you
can choose pay per minute or you can just download that
specific video,” Patrick explained. “And we also have a full
access option as well, where you can stream all our videos
and get all the photo sets for 30 days. Our downloads and
pay-per-minute offers are exclusively with HotMovies;
added, “because we’re high-quality
freaks over here, and we’re just
dedicated to the user. We’ve been
told that by many of them.”
But even that’s not all. The
company even lets users choose
their trial (“a” or “b”) on the
site’s trial page, and the cost? One
measly buck!
As a relatively new company, the deal with HotMovies
should go a long way toward putting Philarise “on the
map,” and Patrick and his partners couldn’t be happier.
“We’re finally starting to get a little bit of attention,” he
noted. “The feedback’s been good on the video we released
on HotMovies yesterday.”
We had to ask if Patrick was willing to reveal any of the
company’s future plans, and he said he’s got something
very special planned for the fall.
“We’re looking into shooting a full-length feature based
on one of our videos which people really seem to like,
which was Werewolf in South Philly. We’ve had a lot people
saying, ‘Why not do a full-length, 90-minute feature with
that?’, and it’s the talk of the moment right now, and the
model we used for that, Cadence Lux (above), is really fun
to work with; she’s the perfect model for the project, and
she confirmed that ready to give it a try. She’s excited to do
it, and it would be released on Halloween like the first one
was. We’re excited to do it, and people want it.”

Streamate Launches Cambuilder
Streamate has released Cambuilder, a new affiliate
program and white label editor. Yuval Kijel, long-time
veteran of the webcam industry, was tapped to lead this
project.
According to Kijel, “Cambuilder will allow any affiliate
